Registering in the directory of lawyers in private practice

REGISTRATION

Click on  REGISTRATION  to display the form (in French only), then complete it and send it to the Curateur public.

The Curateur public exercises powers conferred upon it by the Public Curator Act (R.S.Q. c. C-81), the Civil Code and other legislation. In the course of performing its duties, the Curateur public:

  • often calls upon lawyers to represent persons of full age or minors to whom it acts as tutor or curator;
  • sometimes needs to be represented by a lawyer in connection with a petition, statement of defence or third party claim, during legal proceedings;
  • may require a lawyer's services in any area requiring legal expertise.

The office maintains a directory of attorneys and notaries in private practice, interested in serving the Curateur public.

Selection process

  • To ensure fairness when choosing a lawyer from the directory, the Curateur public picks someone at random, based on criteria associated with the task involved (type of work, region, area of practice, etc.).
  • The Curateur public then telephones the lawyer. If the lawyer refuses the assignment or fails to respond promptly, another lawyer is selected at random, and so on.

Registering in the directory

To register, you have to:

  • accept the conditions for registration shown below;
  • complete the online registration form and send it to the Curateur public, who will send you an e-mail acknowledging your application in a few days.

You may also fax your form to 514 873-5167 addressing it to the "Répertoire des juristes".

Conditions

  • Your name must appear on the membership roll of the Ordre des avocats or the Chambre des notaires du Québec.
  • The Curateur public reserves the right to refuse your registration or remove your name from the directory without notice

Fees

  • The fees charged by lawyers who accept assignments from the Curateur public are set by the Tariff of fees for professional services provided to the Government by advocates or notaries. This fee scale, adopted pursuant to section 49 of the Financial Administration Act (R.S.Q. c. A-6), is shown in the chart below.
  • The number of years' practice1 determined at the beginning of an assignment remains the same until the end of the assignment, even if the lawyer's category changes during the assignment.
  • In certain cases, the Curateur public may opt to pay a flat fee instead of the hourly rate. The flat fee amount is determined by estimating the number of hours required to complete the assignment, and is based on the hourly rate shown here.

Travel expenses

  • Payment of travel expenses is determined by the Conseil du trésor directive entitled Règles sur les frais de déplacement des personnes engagées à honoraires , adopted pursuant to section 22 of the Financial Administration Act (L.R.Q., c. A-6).
  • Lawyers' expenses are reimbursed on presentation of supporting documents.

1.The number of years' practice is calculated from the date on which the lawyer obtained full rights to practice the profession of attorney or notary. This corresponds to the day, month and year of admission to the membership roll of the Ordre des avocats or the Chambre des notaires du Québec.
