Until an incapacitated person is placed under tutorship or curatorship, they are regarded as legally capable of exercising all their rights, including the right to vote and make a will.

HOWEVER, if it can be proved that when the person signed a contract, for example, they were unable to give free and informed consent, the court may annul the act.
An elderly person who is being exploited may contact the Commission des droits de la personne et des droits de la jeunesse. Anyone aware of the situation may also file a complaint with the Commission.
