Protection of the person

When a vulnerable individual is placed under tutorship or curatorship, the Civil Code of Québec makes a distinction between their person and their property. The court may appoint a tutor or curator who is responsible for one of these aspects or both. The same distinction applies in the case of a person under a mandate: one mandatary may look after the person's well-being while another (maybe a trust company) manages their property.

What does protection of the person involve?

Protection of the person means ensuring that the person enjoys proper living conditions (accommodation, food, clothing, care, safety), taking into account their health and income.
