Role of the Curateur public

In addition to representing persons placed under public tutorship or curatorship, the Curateur public performs various functions in connection with private protection measures. The Curateur public:

  • intervenes in the procedure for opening of protective supervision if the situation warrants;

  • informs tutors and curators who require this information how to fulfil their obligations and assists them if necessary, while supervising their administration;

  • may give advice or authorizations to a mandatary executing a mandate that is unclear when the mandatary has to administer property according to the rules regarding tutorship to a person of full age;

  •  has power of inquiry that may be used on its own initiative or upon request, for example if someone reports abuse affecting:

    • the property of a minor,
    • a person under protective supervision,
    • a person for whom a mandate in case of incapacity has been homologated.

The Curateur public also maintains registers of private and public protective supervision and homologated mandates currently in effect. You may consult these registers on this website or through the information department.
