Replacing members of the tutorship council

Ideally, both sides of the child's family - maternal and paternal - should always be represented on the tutorship council.

What should you do if someone resigns from the tutorship council or dies? You will have to choose one of the two alternates appointed by the meeting of relatives. If there is no alternate, you should choose another relative (who may related by marriage) or, as a last resort, a friend. The only formality involved is to inform the Curateur public, the tutor and the child (if they are 14 or over) of the name and address of the new member.

If you are unable to fill the position, you should apply to the court.

If the tutorship council has only one member

An application for a replacement has to be filed with the court. Depending on the situation, this is done by:

  • the sole member, who is resigning;
  • the parents administering a patrimony of over $25,000, who have chosen to have a tutorship council with only one member. 

Secretary

If the secretary resigns, you have to choose another member to fill this position. This will be one of the alternates or, if necessary, someone else. Remember to notify the Curateur public and the other persons mentioned.
