You are a donor, an estate liquidator or an insurer

Civil Code: Remittance of a property (article 217)

If you are going to remit property in favour of a minor child, you are obliged to file a declaration with the Curateur public:

  • if the value of the property is over $25,000, if you are an estate liquidator or donor;
  • whatever the amount involved if you are an insurer (e.g. life insurance company or public agency such as the Société de l'assurance automobile du Québec or the Commission de la santé et de la sécurité du travail)

Content of declaration

Click on the form and you will see that the declaration you send to the Curateur public should contain the following information:

  • your name and contact details (specify in what capacity you are acting);
  • the child's name and date of birth, and social insurance number if they have one; 
  • the names of the legal tutors (or name of the dative tutor to the property or another administrator) and their contact details;
  • the amount to be paid or the value of the property;
  • the date of payment or remittance of the property.

Curateur public

When it receives your declaration, the Curateur public opens a file in the child's name; when declared values attain $25,000, it sets in motion with the parents (legal tutors) the formalities for supervising their administration.

If the tutor's administration is already being monitored by the Curateur public, these declarations will serve as supporting documents during verification of the inventory of property and annual administration report.
