Insurers, liquidators and donors

The following parties are obliged to file a declaration with the Curateur public about property or amounts remitted in favour of a minor child:

  • persons making a donation worth over $25,000;
  • estate liquidators, where the value of the bequeathed property exceeds $25,000;
  • insurers, whether they are public (Société de l'assurance automobile du Québec, Commission de la santé et de la sécurité du travail, Direction de l'indemnisation des victimes d'actes criminels - the agency administering the Crime Victims Compensation Act) or private (life insurers, etc.), who are paying indemnities, annuities or other sums to the minor, periodically or otherwise, regardless of the amount.

What does the Curateur public do?

The Curateur public registers all the amounts declared. It is then able to check that a tutor whose administration it monitors has listed these items in their administration report and inventory of property.

In the case of parents, if the total brought to the Curateur public's attention exceeds $25,000, it will ask them to report on their administration.
