Child's circle

Abuse of the child's person

Anyone aware of abuse must report it to the Director of Youth Protection at a Centre jeunesse du Québec.

In addition to legal or dative tutors and the tutorship council, the law allows anyone in the child's circle to intervene during the tutorship, in order to protect the child's property.

The person wishing to intervene may be a family member, social worker, teacher or neighbour, or even a complete stranger who is aware of abuse, for example.

Interventions regarding the minor's property

Anyone may:

  • initiate the formalities for appointment of a dative tutor, if the parents did not designate one while they were alive or before they became incapacitated;

  • report to the Curateur public an abuse in the administration of the child's property, whether or not this administration is supervised;
  • ask the court to remove the tutor or tutorship council, setting forth a valid reason;

  • contest a decision of the tutorship council for a valid reason within 10 days after the decision is taken;
  • contest the appointment of a dative tutor.
