People involved in tutorship to property

Dative tutor to the person

The dative tutor to the person is responsible for protection of the child's person, and is charged with bringing up the child, educating them and ensuring their well-being.

Protection of minors falls within the competence of Directors of Youth Protection at Centres jeunesse du Québec, not the Curateur public, so this website does not deal with it.

The functions of tutor to the property and tutor to the person are often fulfilled by the same individual.

The tutor to the property is the main player in the tutorship protecting the child's property, but certainly not the only one. Other parties who may be involved are:

  • the meeting of relatives;
  • the tutorship council;
  • the court;
  • the Curateur public;
  • an ad hoc tutor;
  • an administrator other than the tutor (liquidator of an estate to which the child is an heir, trustee, etc.);
  • other persons or agencies who may remit money in favour of the child or give them property, and on whom the law imposes certain obligations;
  • generally speaking, any person concerned about the minor's best interests.

The child also plays a role. As they grow older, their legal incapacity is reduced and they are allowed to exercise a number of rights, including those concerning the administration of some of their property.
