Role of the Curateur public

The Curateur public intervenes in various ways in the administration of the property of a minor child.

  • It informs private tutors to property who have to report to the Curateur public of their obligations, and assists them if necessary.

    In certain cases, the court may decide to place the parents' administration under the supervision of the Curateur public, even if the child's property is worth less than $25,000.

  • In conjunction with the tutorship council, the Curateur public monitors administration of the property of:
    • minors under the tutorship of their parents with patrimony exceeding $25,000;
    • minors with a dative tutor to the property, whatever the value of their patrimony.
  • The Curateur public acts as tutor to the property for minor children with nobody in their circle to perform this role.
  • It has powers of enquiry and may use them on its own initiative or on request; for example if a member of the public reports an abusive situation affecting a minor's property, the matter will be investigated, whether or not this administration is under the supervision of the Curateur public.

The Curateur public also keeps a register of private tutorships to property that are under its supervision and tutorships exercised by the office itself.
